These Terms of Use (“Terms”) govern your access to and use of giavangbac.app, including its pages, data, price tables, charts, conversion tools, articles, features, and information services (collectively, the “Website”).

By accessing or using the Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the Disclaimer published on the Website. If you do not agree, please stop accessing and using the Website.

The Website provides reference information concerning gold, silver, copper, other relevant metals or indices; buying and selling prices; exchange rates; historical charts; conversion tools; educational or analytical content; and other market information.

Unless we expressly state otherwise in writing, we:

• Are not an exchange, credit institution, securities company, fund manager, broker, metal dealer, or investment adviser.
• Do not receive or hold user money or assets and do not place, execute, settle, or guarantee transactions.
• Do not represent any metal dealer, brand, data source, advertiser, or other third party merely because its name, trademark, data, or link appears on the Website.

Unless officially stated in writing, the Website is not affiliated with, represented by, sponsored by, or officially endorsed by SJC, DOJI, PNJ, or any other metals brand mentioned on the Website.

We may add, change, suspend, or discontinue parts of the Website in accordance with applicable law and these Terms. A change will not reduce lawful rights or claims that arose before the change took effect.

Data may be obtained from public sources or provided through third-party APIs, services, or content and may then be standardized, aggregated, or converted by us. We do not describe a source as “official” or “licensed” unless we have an appropriate basis to do so. Sources, products, applicable regions, units, time zone, exchange rates, formulas, and update intervals are disclosed at the point where data is displayed where appropriate.

You understand and agree that:

• Prices may be indicative, quoted, spot, aggregated, or converted prices and may not be prices at which you can actually buy or sell.
• Data may be delayed, interrupted, incomplete, different, or corrected because of market movements, time zones, exchange rates, source changes, technical incidents, or human error.
• Actual prices may differ according to brand, product, purity, weight, quality, location, time, bid–ask spread, fabrication charges, taxes, delivery costs, transaction fees, and each dealer’s terms.
• Charts, conversion tools, and calculators provide estimates based on the displayed data and formulas at the time of use. Rounding may result in minor differences.
• Historical data does not guarantee future prices or performance.

Before entering into a transaction, you must confirm the applicable price, product, terms, and total cost directly with the relevant dealer or source.

We do not fully control the continuity or accuracy of third-party data sources. However, this does not exclude our obligation to take reasonable measures to check data, display its source and update time, warn when data may be stale, correct or remove inaccurate information, and perform any mandatory responsibility under applicable law.

We grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Website for personal, lawful, and non-commercial purposes in accordance with these Terms.

Unless we have given prior written permission or applicable law permits otherwise, you must not:

• Copy, republish, sell, license, distribute, or commercially exploit the Website’s content, database, charts, design, or software.
• Conduct automated collection, bulk extraction, database replication, or use bots, crawlers, scrapers, or similar means, other than ordinary search-engine indexing that complies with robots.txt.
• Circumvent technical controls, access limits, or security measures, or attempt unauthorized access to systems, servers, accounts, or data.
• Disrupt or overload the Website, distribute malicious code, probe vulnerabilities, or use the Website in a way that may harm us, users, or third parties.
• Use the content deceptively, misstate its source, manipulate data, impersonate us, or imply a partnership, sponsorship, or endorsement without permission.
• Use the Website for unlawful activities or in a way that infringes another person’s lawful rights or interests.

To use data in an API, application, commercial product, large-scale research project, or redistribution service, please obtain separate permission or licensing terms from the Website operator.

The Website and elements created by us, including its name, editorial content, selection, organization and presentation of data, charts, interface, design, graphics, source code, and materials, are owned by us or our licensors and are protected to the extent permitted by applicable law.

We do not claim ownership of raw price facts, third-party trademarks, logos, or third-party content. Third-party trade names, trademarks, logos, and content remain the property of their respective owners. Their display is for identification, attribution, or informational purposes and does not by itself indicate affiliation, sponsorship, or endorsement.

Nothing in these Terms transfers any intellectual property right to you other than the limited permission stated in Section 4.

The Website may display advertisements, sponsored content, affiliate links, or links to third-party websites, applications, and services. • Loss caused by market movements, price differences, data latency, exchange-rate changes, or errors or interruptions originating from data sources or third-party services beyond our reasonable control.
• Indirect or consequential loss, loss of profit, loss of opportunity, loss of data, or business interruption, if and to the extent applicable law permits such loss to be limited.
• Events beyond our reasonable control.

Nothing in these Terms:

• Excludes or limits liability that cannot lawfully be excluded or limited.
• Restricts any consumer’s statutory right to complain, bring proceedings, seek compensation, or exercise any other lawful right.
• Releases us from liability for fraud, wilful misconduct, or any other matter for which liability is mandatory under applicable law.

If you identify a price, formula, data source, or other content that may be inaccurate, retain the page URL, the time observed, and a description of the issue to provide through any feedback channel published on the Website, if available. Until the information is verified, you should not rely on it to transact.

Acknowledging or reviewing a report does not constitute an admission of error or legal liability.

We may apply technical measures or restrict or terminate access by a user who breaches these Terms, creates a security risk, disrupts the Website, or infringes our or another person’s rights. Any measure will be applied reasonably and in accordance with applicable law.

We may update these Terms to reflect changes to the Website, our operations, or applicable law. The updated version and its revision date will be published on the Website. Where required by law or where a change materially affects user rights, we will provide appropriate notice.

These Terms are provided in Vietnamese and English with the intention of having equivalent meaning. Where consumer protection law applies and the versions differ, the version or interpretation more favorable to the consumer will prevail as required by applicable law.
